LegalSoftware license
Licensed to you, on your machine, on these terms.
sitereal is paid software with a seven-day trial, and it is not open source. This is the agreement between you and us about the application you downloaded — what you may do with it, what the files it writes are, what a license entitles you to, and what happens when one ends.
The agreement
This license is an agreement between you (the user, whether a person or an organization) and Aufwind Rosebrock & Runnebaum GbR, Harburger Str. 23, 27356 Rotenburg (Wümme), Germany (us). It comes into force when you install or use the application, and it governs every version and build you obtain from us.
It applies from the moment you install the application, to the trial as well as to any license you buy afterwards. If you do not accept these terms, do not install it; if you have installed it, remove it.
The trial and the two licenses
The trial runs for seven days and carries every feature. It requires an account and a payment method, and unless you cancel before it ends it becomes a paid yearly license and your card is charged. If you cancel during the trial, nothing is charged and the application stops opening projects when the seven days are up — everything it has already written to your disk stays where it is, and stays yours.
After the trial there are two licenses. They give you the same application and differ in one respect only, which is how long they run:
- a yearly license, which runs for one year at a time, covers every version released while it runs, and renews once a year until you cancel it;
- a lifetime license, bought once, which never ends and covers every version we ever release.
When a yearly license ends — because you canceled it or a renewal was not paid — the application stops opening projects until you renew. Nothing it has written is removed or locked: your projects are ordinary files on your own disk, they remain yours, and the sites built from them keep building and running without the application or any server of ours.
A license covers one person and up to three machines that person uses. You may release a machine yourself and activate another in its place, so replacing a computer costs nothing and needs no email. It is not a license for several people to share; if you need that, write to us and we will arrange it until there is a plan for it.
Fees, payment and withdrawal
Prices are the ones published on the pricing page at the time you buy. Payment is taken by our payment provider, who acts as the seller of record: the provider concludes the sale with you, issues the invoice, and accounts for the value added tax or sales tax of your country. Prices shown in euro include VAT; prices shown in US dollars are before any tax that applies where you are.
A yearly license renews automatically once a year at the price then published. You may cancel it at any time with effect from the end of the year you have paid for. Canceling stops the renewal and, as set out above, does not stop the application.
If you are a consumer in the European Union you have a statutory right to withdraw from the purchase within fourteen days. Because a license key is digital content supplied at once, that right lapses only where you have expressly agreed to immediate supply and acknowledged the loss of the right at the checkout. Independently of it, we refund any purchase within fourteen days if you ask — the trial exists so that you should not have to.
What you may do
For as long as your trial or your license runs, we grant you a non-exclusive, worldwide license to install and use the application:
- on up to three computers you personally use, one of which you may release and replace at any time;
- for private projects and for commercial ones alike, including client work you are paid for;
- to build any number of websites, with no limit on pages, projects, collaborators or traffic;
- without attributing sitereal on the sites you build — a credit is welcome, never required.
You may make copies of the unmodified installer for backup purposes and to deploy it inside your own organization.
What you build with it is yours
The application writes real files: .astro components, pages, stylesheets, scripts, content and configuration, in your own repository. Those files, and the websites you make from them, are yours. We claim no ownership, no license and no royalty in them, and we impose no conditions on how you publish, sell or license them.
The output carries no runtime of ours and phones nothing home. Remove sitereal from a project and the project still builds — that is a property of the design, and it is not something we may withdraw from you later.
The exception is the application itself: the code that produced those files stays ours, as set out below.
What you may not do
The application is licensed, not sold, and no rights are granted other than those stated here. In particular you may not:
- sell, rent, lease, sublicense or distribute the application, or make it available as a service to third parties;
- modify, adapt or create derivative works of it, or incorporate parts of it into another product;
- decompile, disassemble or otherwise reverse-engineer it, except to the extent that mandatory law expressly permits — in particular § 69e of the German Copyright Act, where interoperability information is not otherwise available to you, in which case ask us first: we would rather answer;
- remove or alter any copyright, trademark or license notice, or the application’s name and marks;
- circumvent a technical restriction in the application, or use it to do anything unlawful.
Redistribution inside your own organization is allowed; redistribution to anybody else is not — send them to the download page instead, so that they receive the current build and these terms with it.
Ownership
The application, its source code, its design, its documentation and its marks are and remain our property and that of our licensors, protected by copyright and other law. sitereal is proprietary software sold under a license; paying for it is not the same as owning it, and no source code license is granted by this agreement.
The open-source components the application is built on stay under their own licenses, which prevail over this one for those components. They are listed under third-party licenses.
Updates and versions
Updates are published as releases and are covered by this license in the same way. The application asks once at startup whether a newer release exists; downloading and installing it are your decision, and the application will not replace itself without a click.
Which versions you are entitled to install is set by your license: a build released inside your license window installs, and one released after it does not. We are not obliged to provide support or backwards compatibility, and we may change or discontinue features. What we do not do is take away your work — nothing the application writes depends on a server of ours, and your sites run without it.
Your data and your backups
The application works directly on files in your file system and writes into your git repository. Take backups and commit regularly. It has an undo history and a snapshot history of its own, but those are conveniences, not a backup strategy, and they cannot protect against a disk failure or a mistaken deletion outside the application.
You are responsible for what you publish. Review what the application has generated — and what any AI agent or other tool you connect to it has written — before a site goes live, and test it where it will run. An agent acts on your instructions and on its own provider’s terms, not on ours; what it writes is a change like any other and deserves the same look before you ship it.
Services you connect — a host, a git provider, a mail provider, a database — are operated by their providers under their own terms. We do not control them and are not responsible for their availability or for how they handle your data.
What the application transmits, and to whom, is described in the privacy policy. It is not much: an update check, an icon search you started, and whatever you configure yourself.
Defects and warranty
sitereal is a young product under active development. New versions change how things work, and a release can contain errors that affect the projects it writes to. Keep your projects under version control, review what the application generates before you publish, and test a site before it goes live.
The application is supplied as it is described on this site and in its documentation. Where you are a consumer, the statutory provisions on digital products apply in full — in particular §§ 327 and following of the German Civil Code, including the obligation to supply the updates you may reasonably expect for a product of this kind, for the period you may reasonably expect them. Nothing in this license limits them.
Where you are not a consumer, we warrant for twelve months from purchase that the application performs substantially as described, and our obligation on a defect is to repair it, to replace the build, or to refund what you paid if neither is possible within a reasonable time. Beyond that, and so far as the law permits, we do not warrant that it is free of every defect, that it fits a purpose you have not told us about, that it is uninterrupted, or that the code it generates suits your project.
Liability
We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, under the German Product Liability Act, and to the extent of any guarantee we have given.
Otherwise we are liable only for breach of a cardinal duty — an obligation whose fulfillment makes performing this agreement possible at all, and on which you may reasonably rely — and then only for the damage typically foreseeable in an agreement of this kind. Liability for any other slight negligence is excluded. It does not extend to loss of profit or indirect damage, and against loss of data the remedy remains a backup and a git history — which is what the application is built to give you.
Term, termination and changes
This license runs until it ends. It ends automatically if you breach a material term, and you may end it at any time by ceasing use and removing the application. The clauses on ownership, warranty, liability and governing law survive it. Your projects and the files the application wrote are unaffected — they are yours, and they stay yours.
We may change these terms for future versions. The version you accepted continues to apply to the build you have; installing a later build means accepting the terms published with it. The date at the top of this page says when it last changed.
Governing law
German law applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory consumer protection provisions of the law of your habitual residence remain unaffected. If you are a merchant, a legal person under public law or a special fund under public law, the courts at our registered seat have exclusive jurisdiction.
You are responsible for complying with any export control and sanctions rules that apply to you when you download or use the application.
Questions about this license — including anything it does not cover, such as bundling sitereal into a service for your clients — go to support@sitereal.app. A license that has to be guessed at is a badly written one; ask, and we will answer in writing.
